Welcome to DLuxxy. These Terms and Conditions govern your use of our website and services. By accessing our site, reserving a kitten, or making a purchase, you agree to comply with and be bound by the following rules.
1. General Provisions
These Terms and Conditions constitute a legally binding agreement between DLuxxy ("we", "us", "our") and the customer ("you", "your"). By placing a deposit, submitting an application, or buying products, you acknowledge you have read, understood, and agreed to be bound by these terms.
We reserve the right to modify or replace these terms at any given time without prior notice. The updated version will become effective immediately upon being posted on this page.
2. Kitten and Cat Reservations and Deposits
2.1 Reservation Process:
To reserve a specific Maine Coon kitten or cat, an approved application and a non-refundable deposit are strictly required. This secure deposit locks your chosen kitten away from public availability.
2.2 Non-Refundable Nature:
All holding deposits are strictly non-refundable. If you choose to cancel your reservation or fail to complete the finalized purchase contract, your deposit is automatically forfeited to cover cattery maintenance assets.
2.3 Final Payment:
The remaining balance on your kitten or cat must be paid in full prior to or at the exact time of transport, pickup, or delivery. Failure to settle the final balance on the scheduled date will result in cancellation of the reservation and forfeiture of your deposit.
3. Health Guarantee (Applies to Cats and Kittens Only)
3.1 Genetic Health:
Every DLuxxy kitten comes with a limited guarantee against lethal congenital or genetic defects (including HCM, SMA, and PK Deficiency) as outlined explicitly inside our separate, physical purchase contract document.
3.2 Initial Veterinary Window:
The buyer is required to have the kitten examined by a licensed veterinarian within 72 hours of taking possession. Failure to complete this initial evaluation within the specified time window completely voids our cattery health coverage.
We provide a detailed documentation trace of up-to-date vaccinations, deworming tracking logs, and a certified health clearance slip prior to departure.
4. Buyer Responsibilities and Care Requirements (Applies to Cats and Kittens Only)
By welcoming a DLuxxy companion, the buyer agrees to maintain the animal under optimal health, environmental, and emotional standards:
- Indoor Living Only: The cat must be kept strictly indoors. Allowing the animal to roam outside unsupervised instantly voids all cattery guarantees.
- No Declawing: Declawing is strictly forbidden. It is an inhumane surgical alteration that fundamentally damages a Maine Coon's physiological health.
- Nutritional Maintenance: The buyer agrees to maintain the specialized diet outlined inside our nutritional logs to preserve proper bone growth density.
5. Return and Rehoming Policy (Applies to Cats and Kittens Only)
If at any point in the animal’s life you are no longer able to keep or care for your Maine Coon, you agree to contact us immediately.
The cat must never be surrendered to an animal shelter, rescue group, or third-party market network. DLuxxy retains the absolute first right of refusal to take the animal back or coordinate a safe, approved rehoming transition to a qualified household environment.
6. Shipping and Transport (Applies to Cats and Kittens Only)
All transport arrangements, including flight nannies or climate-controlled ground shipping routes, are coordinated safely through certified professionals. The buyer is responsible for all associated transport costs, travel kennel assets, and health courier certifications unless explicitly itemized otherwise.
7. Intellectual Property
All original visual media, text copy, graphic configurations, branding badges, and kitten portraits displayed on our site are the exclusive intellectual property of DLuxxy. Our site-wide security scripts strictly block right-click events and asset dragging to prevent unauthorized visual exploitation.
8. Limitations of Liability
DLuxxy shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our services, website information, or third-party intake channels. While we breed for optimal health, veterinary management decisions following possession transfer belong entirely to the buyer.
9. Miscellaneous
These terms are governed and construed in accordance with the laws of the State of Arizona. Any legal disputes arising directly from our cattery agreements must be settled through proper legal channels inside Cochise County, Arizona.
If any provision of these terms is deemed unlawful or unenforceable by a court of law, the remaining structural policies will continue to stand in full force and effect.
